SALES & REFUNDS

Any and all sales are final. Any and all sales will not be refunded. By purchase of the product, the customer is agreeing that they will not open a chargeback. By purchase of the product, the customer is agreeing and understands each product description. 

PRODUCTS

Each product is made to order. By purchasing the product, the customer understands that the finances from each sale is used to build the product they have ordered. Therefore there will be no finances available for refunds as it is used to build the customers product. 

GOVERNING LAW

Each Sale shall be governed by and interpreted in accordance with the laws of the State of New York, without regard to conflict of law principles thereof.

VENUE AND DISPUTES

A. Any and all disputes involving any and all sales, including the breach or alleged breach thereof, shall be submitted to a New York State Court of competent jurisdiction located within Erie County, New York, and shall not be subject to arbitration.  Pending final resolution of a dispute the Seller shall proceed diligently with contract performance.  The Seller waives any dispute or claim not made in writing and received by the County within six months of the occurrence giving rise to the dispute or claim.  The claim must be in writing for a sum certain, and any money requested must be fully supported by adequate documentation. 

B. The Seller hereby voluntarily and irrevocably submits itself to the jurisdiction of all New York State Courts of competent jurisdiction located within Erie County, New York, in which any litigation may be brought based upon or arising out of this Agreement. 

C. Any legal process or notice connected with any litigation may be served upon the Seller in a manner provided by the New York Civil Practice Law and Rules. 

D. This Agreement may be presented in court as conclusive evidence of the foregoing Agreement as to jurisdiction and service of process.
